LFC guest waiver

 

FULL  & COMPLETE RELEASE, AND DEFEND AND HOLD HARMLESS AGREEMENT

IMPORTANT – READ CAREFULLY:  I, the undersigned, acknowledge that the Loveland Fishing Club (hereinafter “the Club” and including the Club’s Board of Directors, members and sponsors, is a not-for-profit club of volunteers which has few assets to pay for legal fees, expenses and judgments; now, therefore, in consideration of the Club allowing me to be a Guest on a Club activity or at a meeting, and to minimize the expenditure of the limited assets of the Club:  1) I, the undersigned Guest, hereby release and discharge the Club from any and all liability, for any reason, which may arise out of, or in connection with, my participation in the activities or meetings of the Club.  For the purposes of this agreement, “liability” means all claims, demands, losses, expenses, causes of action, suits or judgments of any kind which I, my heirs, executors, administrators, assignees or representatives may have or assert against the Club, because of my personal injury, death or illness, or because of any loss of or damage to my property, which may occur during, or as a result of, my participation in Club activities or meetings.

2)   I, the undersigned Guest, further agree that I, my heirs, executors, administrators, assignees or representatives, shall defend, indemnify, and hold harmless the Club:  a) from any and all liability, as defined above, resulting from, or in any manner arising out of, any such liability asserted by me, my heirs, executors, administrators, assignees or representatives, as a result of my participation in any Club activities or meetings; and b) from any such liability asserted by others because of any alleged negligence on my part during my partipation in Club activities or meetings.
